What is arbitration?

Arbitration is a form of alternative dispute resolution (“ADR”). ADR is a mechanism for the resolution of disputes outside the court system. The parties to a dispute refer it to arbitration by one or more persons (the “arbitrator(s)”), and agree to be bound by the arbitration decision (the “award”). Arbitration is an alternative to court litigation that in many cases is mandatory by virtue of a provision in written contract.

What is mediation?

Mediation, is a form of alternative dispute resolution (“ADR”). ADR is a mechanism for the resolution of disputes outside the court system. During a mediation, the mediator, a third party neutral, assists the parties to negotiate a settlement. Mediation may be used to facilitate the resolution of a dispute in all types of disputes ranging from commercial, legal, diplomatic, workplace, community and family matters. Mediation is an alternative to court litigation that in many cases is mandatory by virtue of a provision in written contract.
